West Virginia lets a taxpayer subtract from federal adjusted gross income (AGI) everything paid into SMART529 or another program run by the state's College and Jumpstart Savings board, with no dollar cap. A Morgantown couple at $90,000 who contribute $15,000 save $687 on the 2026 return. The rare feature is the election in Code 11-21-12a: a taxpayer may spread the subtraction over up to five taxable years starting with the year of payment, which keeps a large deposit from sliding down the brackets. The 2026 table has five rates, from 2.11 % to 4.58 % above $60,000, the same for single and joint filers. Only the state's own plans count. Withdrawals for K-12 costs up to $20,000, credentials and Roth IRA rollovers follow federal law, according to the plan, and a rollover to another state's 529 brings nothing back into West Virginia income.

One deposit, up to five returns
An unlimited subtraction has a weakness: past a certain size, each extra dollar comes off income that was taxed at a lower rate. West Virginia answers it with an election. Code 11-21-12a allows the modification to be taken over as many as five taxable years, beginning with the year of payment.
Suppose the couple above sells a lot and puts $60,000 in SMART529. Taken in one year, the subtraction drops their income well below $60,000 and saves $2,534. Spread as $12,000 a year over five returns at the same income, each slice stays in the 4.58 % band and the total reaches $2,748, a gain of $214. The comparison assumes the income stays at $90,000; a drop in a later year would change it, and the money saved later is worth slightly less than money saved now.

A short bracket table
Code 11-21-4j sets one table for single, joint and head of household returns from 2026, so a teacher filing alone at $52,000 pays 4.22 % at the margin and saves $127 on $3,000. Married people filing separately use half thresholds. Section 11-21-4h provides for further cuts in later years if revenue triggers are met, which would lower the value of slices taken after 2026.
Board-administered plans only
Code 18-30-9 ties the deduction to programs administered by the board: SMART529 WV Direct, The Hartford SMART529 sold through advisors, and SMART529 Select. The same $15,000 in another state's plan saves $0. The Offering Statement and its supplements that we read set the account ceiling at $550,000 per beneficiary; we found no later increase.
Leaving SMART529 is free of add-back
The Offering Statement excludes rollovers to another 529 plan from its definition of a non-qualified distribution and describes them as a way of taking money out with no income tax due. A non-qualified withdrawal is different: its contribution portion must be added to West Virginia income in the year of the withdrawal, to the extent it was deducted. Both rules come from the plan's own document. We found no add-back clause in the tax code itself and no statement from the Tax Department.
On the 2025 federal law, the plan's supplement on H.R. 1 says West Virginia follows the federal code for expanded K-12 expenses and credential programs, and the plan's K-12 flyer calls those withdrawals free of federal and state tax up to $20,000 per student per year. Roth IRA rollovers are treated consistently with federal law. Student loan repayments are the gap: no official text we read addresses them for West Virginia tax.
